My employer isn’t paying me correctly. What can I do?

Your employer should pay you on time (your agreed pay day) for work you’ve done. You can challenge your employer if:


  • They haven’t paid your wages.

  • They have underpaid you.

  • They’ve deducted some or all of your wages, and you don’t agree with their reason for doing so.

 

What steps can I take if I have not been paid?


  • If you have a payslip, you can check it to help you determine the problem.


  • You can talk to your employer to find out why you have not been paid what you expected. If they have made a mistake, you can immediately ask them to pay you. There is no need for you to wait until the next day.


  • If your employer still hasn’t paid you despite you talking to them, you can take legal action against them. You can do this even if you decide to resign.

 

What if my employer has underpaid me?


Check your payslip to find out what the problem leading to you being underpaid is. You can also use your payslip to show your employer what you think they owe you. If you do not have a payslip, ask your employer for one.


Your payslip should include the number of hours you’ve worked in the pay period covered by the payslip. Check to see what dates the payslip covers and then check if your employer has correctly paid you for all the hours you worked within that pay period.

You should also check that you have been paid for everything you are entitled to be paid for. You may be entitled to pay for:


1.      Sick pay

2.      Training time

3.      Holidays

4.      Maternity, paternity or other parental leave


What are the immediate options available to me if my employer hasn’t paid me correctly?


Explain the situation to your employer


Communicate to your employer how much you believe you are owed and why you believe you are not being paid properly.

 

Provide evidence


Gather any documentation that supports your claim, such as your employment contract or your payslip.

 

Ask for immediate correction


If you have not been paid due to an error on your employer’s part, ask to be paid immediately.

 

What can I do if the issue persists?


Raise a grievance


If your employer has a grievance procedure, follow the steps outlined in that procedure to formally raise your concerns with your employer.
